TERMS OF SALES
Please read these Terms of Sale carefully before ordering our products online from FUSION LIMITED (www.Buys.hk) (the “Website”).
These Terms of Sale create a legally binding agreement between you and COTY INT Hong Kong Limited (which we may refer to as “Coty,” “We,” “Us,” or “Our”) regarding orders placed for products available on the Website. We may revise these Terms of Sale without notice by posting revised Terms of Sale on the Website. The Terms of Sale posted on the Website at the time you place your order on the Website will govern that purchase. Please read these terms carefully and check that the details of your order are complete and accurate before submitting your order.

3. PRODUCTS INFORMATION
We will try to describe the products and provide information as accurately as possible on this Website, but within the scope permitted by applicable law, We do not guarantee that the product description, colour, information or other content contained on this Website are accurate, complete, reliable, effective or infallible. We reserve the right to correct any errors, inaccuracies or omissions at any time (including after order submission) and to change or update any information without prior notice.
4. PLACING ORDERS
4.1 ELIGIBILITY TO ORDER
To place an order on the Website, you must be of legal age in your country and a consumer - not a reseller.
4.2 HOW TO ORDER
You need an e-mail address to place an order, when you submit an order and complete the payment of order price in full, we will send you an email acknowledging the acceptance of your order - we will send you an email confirming that the payments are completed and your order is confirmed(“Order Confirmation”). At this point a contract, containing these Terms of Sale, comes into existence and is binding on you and us (the “Contract”). We recommend that you print or download a copy of these Terms of Sale and the relevant Order Confirmation for future reference. If we are unable to supply you with a product, we will inform you of this in writing and will not process the order.
4.3 OUR RIGHT TO REJECT YOUR ORDER OR CANCEL A CONTRACT
Fulfilment of all orders on the Website is subject to availability. We explicitly reserve the right to cancel a Contract by written notice to you in the following situations, without being liable for any damage or costs other than repayment of any amount received from you in relation to the Contract we cancelled:
- the product is not available / in stock;
- your billing information is not correct or not verifiable;
- we believe you are under the legal age in your country;
- we believe that you are a reseller;
- there was an error in the price displayed on the Website;
- we could not deliver to the address provided by you;
- due to an Event Outside Our Control (see below);
- in the event of misspelling, pricing or other errors or mistakes in the Website information.
5. TITLE TRANSFER
The risk of loss and title for products purchased from Us pass to you upon our delivery to the carrier.
6. PAYMENT PROCESSING
We only accept payment via your credit card (including Visa and MasterCard). You must pay for the Products at the time of placing the order on the Website.
Payments can only be processed if the billing information can be verified.
7. PRICES AND CURRENCY
The product prices displayed on the Website are inclusive of Value-Added Tax (VAT) as applicable and quoted in Hong Kong Dollar. Shipping rates are applied per order.
8. YOUR TOTAL PRICE
The total price specified in the final check out screen includes tax and shipping costs. This price will be recorded in the Order Confirmation, which we recommend you print or download for future reference. If paying by credit card, the total amount for your entire order will be reflected on your statement in your local currency.
9. PRICE CHANGES
The prices of the products will be as displayed on the Website. Prices may change from time to time, but changes will not affect any order which we have confirmed in an Order Confirmation.
10. SHIPPING & DELIVERY
10.1 DELIVERY – WHERE AND WHEN
We offer standard delivery (5-10 business days after Order Confirmation) for you carried out by the Currier appointed by Us. We do not ship on certain public holidays. We can only fulfil an order to a delivery address which is a home or office address in one of the countries listed in the help section of the Website. We will send you an email to notify you once the Product you ordered is dispatched and courier waybill will be presented in the email.
10.2 INSPECTION UPON DELIVERY
Upon delivery, please inspect the packaging for damage. If it appears that the products are damaged, please do not accept the shipment and contact Coty customer care at 852-3018-4567.
10.3 SHIPPING RATES
We normally offer free shipping for any order exceeding the value of $500 HKD (excl. outlying islands). Shipping fee applies when order below $500 HKD and will be quoted at check-out page and paid at check-out.
We will also offer free-delivery” from time to time regardless the order amount on certain events, which is subject to Our sole discretion.
11. RETURNS & CANCELLATIONS
11.1 ORDER CANCELLATION
You are not entitled to cancel the Contract after Order Confirmation, except under the circumstances provided below:
- In case of an Event Outside Our Control;
- the delivery is delayed for  days from the estimated delivery date;
- Other reasons that is vetted and identified by Coty customer services representatives.
11.2 RETURNING ORDERS AFTER DELIVERY – DEFECTIVE PRODUCTS
You are entitled to exchange products delivered to you in the event that they are defective or otherwise not in conformity with your order when you received them This does not affect your statutory rights. In the event your claim is justified, You must return all the product(s) in the same order, all gifts received along with the same order, and we will offer you same product or product of same value after we receive your return. 11.3 REFUND INFORMATION

12. EVENTS OUTSIDE OUR CONTROL
An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks.
If an Event Outside Our Control takes place that affects the performance of our obligations under these Terms of Sale, Our obligations Under these Terms of Sales will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control.
Where the Event Outside Our Control affects Our delivery of a product to you, we will arrange a new delivery date with you after the Event Outside Our Control is over. You may cancel the contract if an Event Outside Our Control takes place and you no
longer wish us to provide the products. Please see your cancellation rights under Cancellation above.
13. OUR LIABILITIES TO YOU
We are not liable for any indirect, special, punitive, incidental or consequential damages (including loss of profit or loss of business) of any kind bears any responsibility,regardless of the form of liability, whether based on contract guarantee,
infringement (including negligence) or other aspects. In any case, the maximum total liability of Us will not exceed the higher of (a) the total price paid by you in an order or (b) one thousand Hong Kong dollars (HK $ 1,000.00).
14.1 ENTIRE AGREEMENT
If any court, arbitrator, or arbitration panel finds any clauses to be invalid or otherwise unenforceable, that clause will be void to the extent it is contrary to applicable law.However, that finding will not affect the validity of any other clauses, and the rest of these Terms of Sales will remain in full force and effect. Alternatively, if a court, arbitrator, or arbitration panel determines that any clause is not enforceable as expressly written, it is the intention of you and Us that those clauses be modified by the court, arbitrator, or arbitration panel only as is necessary for them to be enforceable.
14.3 GOVERNING LAW AND DISPUTE RESOLUTION.
The Contract and these Terms of Sales shall be governed by Hong Kong law and the Hong Kong courts shall have jurisdiction to resolve any dispute between us.
If there is any discrepancy between the English and Chinese versions, the English version shall prevail.
